​Employment Standards Act Changes to Prohibit Asking Employees for Doctor's Notes

Changes are coming to the Employment Standards Act which governs the relationship between businesses/employers and their employees.  Once passed, the new rules will ban employers from asking an employee for a Doctor's Note or Sick Note when they take a regular sick day(s). 

Currently, the law allows employers to request “reasonably sufficient proof” that an employee is sick. The changes will mean that employers can’t request, and employees are not required to provide, a Doctor's Note or Sick Note. 

Regulations will be established following engagement with stakeholders, which the Langley Chamber will participate in.   These regulations will set out how long and how often an employee can be off sick before an employer CAN request a formal sick note. 

Businesses should be aware of these looming changes and consider updating their policies and practices around sick days.   The Langley Chamber will also be engaging on this legislation and the coming regulations to ensure it does not move us closer to 10-days of mandated paid sick leave.
